An Open Letter to Representative Kate Knuth
What is your position on HF 3709 (https://www.revisor.mn.gov/revisor/pages/search_status/status_detail.php?b=House&f=HF3709&ssn=0&y=2010), a bill that essentially incorporates the recently enacted federal health care legislation into Minnesota law?
In my view your oath of office obligates you to oppose this legislation. This should not be difficult as the federal "ObamaCare" legislation is unconstitutional on several grounds starting with, but not limited to, a blatant violation of the 10th Amendment to the US Constitution (http://caselaw.lp.findlaw.com/data/constitution/amendment10) in that the US Congress does not even have the authority to enact this legislation. It was also opposed by the vast majority of US citizens, and was quickly rammed through the US House and Senate through use of some very ethically and legally questionable tactics.
As one of your constituents who follows these things closely, I urge you to do all you can to assure that this legislation is defeated in the Minnesota House as quickly as possible and would like a confirmation of your position. If you must support any part of it, the verbiage in the summary that reads "MinnesotaCare program and related taxes repealed" would be fine as long as the rest of the bill is completely thrown out. Other than the elimination of the failed MinnesotaCare program, passage of HF3709 would be a gross disservice, as well as a violation of your oath of office, to your constituents and to the rest of the residents of Minnesota. We do not need to compound the many other problems facing the State of Minnesota by adopting such blatantly unconstitutional and common-sense repugnant provisions into state law.
Please let me and the rest of your constituents know where you stand on this issue and what you base your position on as it will be an important part of the our decision as to whether you retain your position as our representative or are replaced with someone who will uphold their oath of office and support our interests.
